Terms & Conditions

These Terms & Conditions apply to all workshops, masterclasses, trainings, courses, mentoring sessions, ceremonies, online and in person sessions. It is very important that you read them before choosing to participate, as they contain essential information about keeping yourself safe and getting the most out of your experience working with us.

This Agreement is made on the date of Application.

BETWEEN:

Eleventh Element Pty Ltd Trading as High Alchemy (ABN 14 625 311 739).

and

You, the participant (your details are provided in your sign up form).

By submitting a sign-up form to work with us, you are indicating that you have read and agree to be bound by these terms and conditions.

Payment

Your reservation is confirmed when we receive your deposit. You are making an intentional commitment to this work from the moment you sign up, so we do not offer a refund for change of mind. It is common for shifts to start happening immediately, which can bring up resistance and anxiety, so your informed consent is essential. Please make sure you have done your research, understand what is being offered and are ready to participate before you pay your deposit. Full payment is required before participation, unless a payment plan has been arranged in advance.

Suitability

We care about your safety and want to make sure you are a good fit for working with us. We recommend that you contact us to discuss your participation BEFORE signing up if you have any concerns. Our work is not recommended for anyone who:

  • has been diagnosed or hospitalised for a mental health condition
  • is currently being treated for a mental health condition, trauma or PTSD
  • has a history of severe trauma or untreated PTSD
  • has taken or is currently on medication for mental illness
  • has had a psychotic episode or experienced mental instability
  • has rage/anger outbursts that they cannot control
  • is pregnant, or
  • is physically weak.

Please reconsider your participation if you do not feel fully resourced and supported to do this work (including emotionally and financially). This work is best approached from a place of stability.

By signing up to participate, you acknowledge that none of the above conditions applies to you, or if they do, you have sought appropriate medical guidance from your GP.

Disclaimer & Indemnity

You acknowledge that all information, techniques taught, and advice given, are intended for educational and entertainment purposes only. This workshop is not intended to replace the services of a physician, or to provide an alternative to professional medical diagnosis or treatment. It is not intended to provide an alternative to all other relevant professional advice. It’s not intended to take you away from your current health programme. It is not intended to diagnose, treat, cure or prevent any disease or condition. If you think you have any type of medical or mental health condition you must seek advice from your physician or an appropriately qualified professional.

You agree to always consult your physician and other relevant professionals before implementing any of the suggestions or rituals from High Alchemy trainings and sessions.

You take full responsibility for your implementation of any suggestions that we may make while providing our services. You understand that our advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take. Always listen to your body, do your own research, and check with appropriately qualified professionals before making major decisions or significant changes. You agree to indemnify us against all consequences arising directly or indirectly from your choices.

While we make all reasonable efforts to ensure that our services meet with the highest standards of best practice, if something does go wrong that is not a direct result of our negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, we will not be liable for any loss or damage arising out of or related to our services.

You expressly agree that if this clause is unenforceable for any reason, our total cumulative liability for all causes of action of any kind (other than negligence or deliberate wrongdoing) shall not exceed the amount that you have paid to us.

Refund Policy

There are no refunds given if you fail to show up to an in-person event or online training. If you are prevented from participating due to circumstances beyond your control, please contact us to provide evidence. We may offer a refund or credit towards a different offer at our discretion.

We are not responsible for any failure or delay due to events beyond our control. This also covers cancelling or rescheduling events due to insufficient numbers.

If such an event happens, we will inform you in writing as soon as we can. We will explain the event and what steps are being taken to reduce its impact. You agree to work collaboratively with us and explore alternative options to minimise the impact of the force majeure event as much as reasonably possible.

Participant Covenants

By participating in training offered by Eleventh Element Pty Ltd (ABN 14 625 311 739) trading as High Alchemy (“us, our”), you agree to the following:

1. Nature of the Training

The training we offer involves experiential learning, personal development, and embodied practices. It is not a substitute for medical, psychological, or therapeutic treatment.

You participate voluntarily and take responsibility for your own wellbeing, choices, and integration of the material.

2. Intellectual Property and Confidential Material

The training methods, frameworks, processes, materials, recordings, and documentation that we use and provide are owned by or licensed to Eleventh Element Pty Ltd.

Many elements of the training are shared in confidence and are considered proprietary trade secrets and commercially sensitive.

3. Copyright Notice and Contact

All copyright in live and online presentations is owned by or licensed to Eleventh Element Pty Ltd. These materials are provided for personal use only.

If you are unsure whether a proposed use is permitted, you are encouraged to contact us at katie@eleventhelement.com.au before proceeding.

4. Permitted Use

You may:

  • Use High Alchemy material for your personal learning, reflection, and development, and
  • Speak generally about your own personal experience of the training, provided you do not disclose specific techniques, processes, or proprietary content.

5. Prohibited Use

Unless expressly authorised by us in writing, you must not:

  • Teach, train, facilitate, or instruct others in any High Alchemy techniques or methodologies.
  • Share, reproduce, record, distribute, publish, or sell any High Alchemy Material.
  • Use the High Alchemy Material in a way that competes with, substitutes for, or undermines High Alchemy business.
  • Present High Alchemy techniques as your own, or as part of another program, offering, or modality.

If you wish to explore becoming an authorised teacher or facilitator, you agree to approach us directly to discuss the appropriate pathway.

6. Confidentiality

You must not disclose confidential aspects of the training, including specific practices, sequences, language, or frameworks, whether in person, online, or via any communication or social media platform, unless authorised by us in writing.

7. Artificial Intelligence and Data Use

You must not upload, input, or reproduce any High Alchemy Material into AI tools, databases, or automated systems (including large language models) without prior written permission. This includes both original High Alchemy Material and substantially similar reproductions, such as summaries or extracts.

13. Participant Conduct Policy

By participating in any training offered by High Alchemy, you acknowledge and agree that:

  • We have a responsibility to create and maintain a safe, respectful, and supportive environment for all participants.
  • Certain behaviours are not permitted during training, including behaviour that is disruptive, unsafe, or disrespectful to others. This includes, without limitation, being intoxicated or under the influence of drugs or alcohol, or engaging in conduct that interferes with the learning environment.
  • If we reasonably consider that your behaviour compromises the safety, wellbeing, or integrity of the group or the training space, we may require you to leave the training, either temporarily or permanently.
  • Where you are required to leave due to your behaviour, you may not be entitled to a refund for the affected training. This does not affect any rights you may have under Australian Consumer Law.
  • Decisions regarding participant conduct are made by our facilitators, acting reasonably and in good faith, having regard to our responsibilities to all participants.

8. Fees and Payment

You agree to pay all agreed fees when due.

If we are required to take steps to recover unpaid fees, you agree to be responsible for any reasonable debt collection costs which we incur.

9. Risk, Liability, and Consumer Guarantees

You acknowledge that participation may involve emotional, physical, or energetic experiences and that outcomes vary between individuals.

To the extent permitted by law, we exclude liability for loss or damage arising from participation. Nothing in these terms excludes, restricts, or modifies any consumer guarantee or right you are entitled to under Australian Consumer Law, including liability for personal injury caused by negligence.

10. Indemnity

You agree to indemnify us for reasonable losses, costs, or claims arising directly from your breach of these terms, including unauthorised teaching, disclosure, or commercial use of High Alchemy Material.

11. Consequences of Breach

If you breach these terms, we may:

  • Require you to immediately stop the prohibited conduct.
  • Seek injunctive or other equitable relief.
  • Recover reasonable losses and enforcement costs as permitted by law.

12. Governing Law

This agreement is governed by the laws of Victoria and the Commonwealth of Australia.

Delivery of Goods

Physical goods are delivered by Australia Post and/or other reputable courier services.

Orders are processed promptly once full payment has been received. Delivery timeframes are estimates only, and typically range between 2 and 14 days, depending on your location and the delivery option selected.

If your order is damaged in transit or not received, please contact us as soon as reasonably practicable so we can investigate and assist. Nothing in these terms limits your rights under the Australian Consumer Law in relation to lost, damaged, or faulty goods.

Digital goods are made available for download immediately after purchase, unless otherwise stated.

While we take reasonable steps to ensure digital products are accessible, you acknowledge that downloading digital content may be affected by factors outside our control, such as your device, internet connection, or software compatibility.

If you experience technical difficulties accessing your digital goods, please contact us and we will make reasonable efforts to assist.

Cancellations and Refunds

We handle cancellations and refunds in accordance with the Australian Consumer Law.

Each event, programme, or offering may have its own specific terms and conditions, which will be provided to you at the time of registration or purchase and form part of your agreement with us.

Unless otherwise stated, programmes and events are non-refundable for change of mind including where you are unable to attend or complete the programme. This is because with our programmes you gain instant access to our intellectual property, and places at events are limited. Please make sure you are ready to make this commitment before you sign up.

Our website may contain information, links, advertisements, or content provided by third parties. We do not control, endorse, or take responsibility for the accuracy, or advice provided by those third parties.

Based on our experiences and observations with past clients, we are convinced that you have the power to create deep transformational change. If you truly believe in something, you can achieve it. However, because belief is deeply personal and subjective, we cannot guarantee any specific outcomes or results. The success you experience will largely depend on your own efforts and personal circumstances, which are factors outside our knowledge and control.

Divination & Personal Responsibility

You understand that any divination practices (including tarot, water divination or similar intuitive processes) are offered as a tool for reflection, insight and personal exploration. They are not a substitute for professional advice (including medical, legal, financial or psychological advice). You are the one who gives meaning to what arises, and you remain responsible for the choices you make from there.

This work is designed to support your self-awareness, not replace your own judgement. We do not make predictions or guarantees about future outcomes, and we do not tell you what decisions to make. You remain fully responsible for your own choices, actions and interpretations of any insights that arise during our work together. You agree to approach this work with personal responsibility, and to seek appropriate professional support where needed.

Whole Agreement

These terms and conditions plus the attendance agreement represent the whole agreement between you and Eleventh Element Pty Ltd concerning your use and access to our websites and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the state of Victoria and the Commonwealth of Australia. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.

Exclusion of Unenforceable Terms

If any part of these Terms is held to be void, illegal or unenforceable, the relevant part can be removed without affecting the validity, legality or enforceability of any other part of these Terms.

Jurisdiction

This Terms are subject to the governing law of Victoria, Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Victoria, and the Commonwealth of Australia, will have exclusive jurisdiction.

Booking your session indicates that you have read and agreed to the terms and conditions. Your session with High Alchemy is not intended as a substitute for medical diagnosis or treatment. You should seek the advice of a qualified medical practitioner before commencing any treatment or if you have any questions related to your mental or physical health, physical fitness, or medical conditions. We recommend that you do not stop or alter any treatment you are currently receiving without the prior consent of your doctor or mental health advisor.

High Alchemy is not responsible for, and will not be liable for, any action or decision you or any other person takes in reliance on information provided during a session, course, or on our website. Participating in any course or session does not guarantee any particular outcome, and you acknowledge that outcomes may vary between individuals. Our fees are charged for the provision of our time, experience, and expertise, regardless of outcome.

High Alchemy reserves the right to accept, decline or discontinue working with any client on a case-by-case basis, acting reasonably and in good faith. Acceptance into, and continuation of, sessions or programmes is at our discretion, having regard to the safety, wellbeing and appropriateness of the services for all involved. We are not obliged to provide reasons for declining or discontinuing services. Any person who attends a session while under the influence of alcohol or drugs will not be seen or treated.

Note: there may be occasions, where scheduling conflicts, require that we need to arrange an alternative time for your appointment slot. We will contact you to arrange a suitable time, should this be necessary.
